The National Energy Efficiency Fund

The National Energy Efficiency Fund (FNEE), constituted by Law 18/2014, of October 15, has the purpose of financing national energy efficiency initiatives, in compliance with article 20 of Directive 2012/27/UE of the European Parliament and of the Council, of October 25, 2012, modified by Directive (UE) 2018/2002.

Attached to the Ministry for the Ecological Transition and the Demographic Challenge, through the Secretary of State for Energy, it is managed by the Institute for Energy Diversification and Saving (IDAE), as established in article 73 of Law 18 /2014, subsequently modified by Royal Decree-Law 23/2020, of June 23.

The resources of the FNEE are dedicated to the financing of economic and financial support mechanisms, technical assistance, training, information, or other measures in order to increase energy efficiency in different sectors, so that they contribute as a whole to achieving the objective of national energy saving provided for in article 7 of Directive 2012/27/EU of the European Parliament and of the Council, of October 25, 2012, modified by Directive (EU) 2018/2002.

National energy saving target according to the Energy Efficiency Directive of the European Union

Directive 2012/27/EU of the European Parliament and of the Council, of October 25, 2012, on energy efficiency, amending Directives 2009/125/EC and 2010/30/EU, and by which repeal Directives 2004/8/EC and 2006/32/EC, created a common framework to promote energy efficiency within the Union and establishes specific actions in order to achieve significant cumulative energy savings in the 2014-2020 period.

Article 7 of the previous Directive established the obligation to justify, by each Member State, an amount of accumulated energy savings for the 2014-2020 period, which for Spain was 15,979 ktep.

Once the 2014-2020 period ended, Directive 2012/27/EU was modified by Directive (EU) 2018/2002 of the European Parliament and of the Council, of December 11, defining a new savings target for each Member State, for the 2021-2030 period, with Spain's new target set for the new period being 36,809 ktep.

Operating mechanism of the National Fund for Energy Efficiency

The Energy Efficiency Directive establishes that Member States can achieve the amount of energy savings required by establishing a system of energy efficiency obligations in accordance with its article 7 bis or adopting alternative action measures in accordance with article 7 ter. In addition, Member States may combine a system of energy efficiency obligations with alternative policy measures.

Based on objective and non-discriminatory criteria, the Member States shall designate the obligated parties among energy distributors, retail energy sales companies, and transportation fuel distributors or retailers that operate in their territory. The amount of energy savings necessary to comply with the obligation shall be obtained by the obligated parties from among the final customers, designated by the Member States, regardless of the calculation made in accordance with Article 7(1), or, if so decided by the Member States, through certified savings from other parties, as described in paragraph 6, letter a), of said Article 7.

As a result of the previous paragraphs, Law 18/2014, of October 15, modified by Royal Decree-Law 23/2020, of June 23, creates the national system of energy efficiency obligations, by virtue of which it will be assigned to gas and electricity trading companies, wholesale oil product operators, and wholesale liquefied petroleum gas operators

The annual energy saving objective, the savings quotas or obligations corresponding to each of the obligated subjects and their financial equivalence will be set annually by order of the Minister for the Ecological Transition and the Demographic Challenge, prior agreement of the Government Delegate Commission for Economic Affairs. The annual energy saving objective of each obligated entity will be calculated by multiplying the energy sales corresponding to each of the aforementioned subjects in year n-2 (n being the reference year of the obligation), by the result of dividing the objective average annual savings for the period 2015-2020, divided by the average annual sales volume of all regulated entities considered in the corresponding published ministerial orders establishing the financial contribution obligations to the National Energy Efficiency Fund in said period , multiplied by a factor, which may vary throughout the 2021-2030 period, so as to achieve the final energy saving objective established in article 7 of Directive 2012/27/EU, modified by Directive (EU) 2018/2002, in the period 2021-2030.

With the financial resources of the National Energy Efficiency Fund, measures are put in place to increase energy efficiency in the different sectors and help achieve the established national saving obligation. For the new 2021-2030 period, it is noteworthy that, when conceiving the action measures to comply with the obligation to obtain energy savings, the need to alleviate energy poverty must be taken into account, establishing a quota of energy efficiency measures that must be applied as a priority among vulnerable households, including those affected by energy poverty and, where appropriate, in social housing.

Monitoring and control committee

The supervision and control of the Fund will correspond to a Monitoring and Control Committee attached to the Ministry for the Ecological Transition and the Demographic Challenge, through the Secretary of State for Energy, which, under the chairmanship of its owner, will be made up of the owners of:

a) The General Directorate of Energy Policy and Mines.
b) The General Directorate of the Institute for Energy Diversification and Saving (IDAE), M.P.
c) The Spanish Office for Climate Change
d) The Department of Economic Affairs and G20 of the Cabinet of the Presidency of the Government.
e) A representative with the rank of Director General of the following ministerial departments:

1st. Treasury.
2nd. Ministry of Transport, Mobility and Urban Agenda.
3rd. Ministry of Economic Affairs and Digital Transformation.

The secretary of the Committee will be appointed by the President, among officials of the Secretary of State for Energy of the Ministry for the Ecological Transition and the Demographic Challenge with the rank of Deputy Director General. The Government, by royal decree, may modify the composition of the Committee.
