Energy Certification of Buildings
The Energy Certification of Buildings is a demand derived from Directive Directive 2002/91/EC. As regards energy certification, this Directive is partially transposed into the Spanish legal system through Royal Decree 47/2007, of 19th January, approving the Basic Procedure to certify energy efficiency in new-construction buildings.
This Royal Decree 47/2007, of 19th January, was enforced last 1st November: from now on, it is compulsory to have an Energy Efficiency Certificate at the disposal of the buyers or users of buildings.
With this certificate and with an energy efficiency label, every building is allocated an efficiency Energy Class which will range from class A, for the more energy-efficient ones, to class G, for the least efficient ones.
Section 3 of the above-mentioned Royal Decree sets out the creation of the General Register of acknowledged documents for the energy certification of buildings. Of a public nature, it depends on the Secretariat General of Energy of the Ministry of Industry, Tourism and Trade, and was created for dissemination purposes.
This register records the Documents acknowledged for energy efficiency certification. These documents, of a technical nature but without a regulatory nature – are created with a view to facilitating the enforcement of the basic Procedure described in the Royal Decree, and have to count on the joint recognition of the Ministry of Industry, Tourism and Trade, and with the one of the Ministry of Housing.
On the other hand, and as it names suggests, the said RD 47/2007 sets out the basic procedure for the energy efficiency certification of new construction buildings. This procedure will be developed by the competent body in this issue in the relevant Autonomous Community - also in charge of the register of the certifications in its territorial jurisdiction, the external control and the inspection.
